Before pursuing to litigation, issues that may be raised from an early stage and which relate to aspects of contract law can include amongst others determination of whether a given party has breached the given contract. Should this issue arise, the party through his or her lawyers will need to consider whether there is an enforceable contract, what the terms of the contract are, whether any implied terms exist as well as ultimately whether the contract was breached.

On 14 July 2016, the House of Representatives approved changes to the Immovable Property Tax Law (the “Law”). The amendments, which were published in the Official Government Gazette on 25 July 2016, reduce the immovable property tax burden for tax year 2016 by up to 75% and abolish the immovable property tax as from 2017.

On the 30/12/2015, The Government of the Republic of Cyprus and the Government of the Federal Democratic Republic of Ethiopia have signed the Agreement on the Avoidance of Double Taxation and the Prevention of Fiscal Evasion with respect to Taxes on Income.

The Organisation for Economic Co-operation and Development proposed a Common Reporting Standard (CRS) for the Automatic Exchange of Information with the aim of improving international tax compliance and preventing tax evasion, through the automatic exchange of information between countries that implement CRS, one of which is the Republic of Cyprus.

In a recent case, the Supreme Court of Cyprus (single Judge), in certiorari proceedings, decided to cancel a warrant issued against a Cyprus law firm for the search of its premises and offices on the ground that the law firm illegally withheld certain important documents, concerning the commission of serious crimes by the lawyer’s clients.

In a recent decision of a Cypriot 1st Instant Court issued in the context of an application for enforcement of a foreign arbitral award on the basis of New York Convention, it has been inter alia held, that a dismissal of such enforcement application, on the ground that the applicant has not presented all the required documents under Article IV of the Convention, does not engage the res judicata rule, and the applicant may file a new request, for recognition or enforcement of such foreign arbitral award.

In the recent case RE: ANTONAKIS ANDREOU & CO LLC, a Supreme Court Judge, in Certiorari proceedings, cancelled a warrant issued against a lawyer and his law firm, for the search of the lawyer’s premises, on the ground that the law firm withheld certain important documents, relating to the alleged commission of serious crimes, by a client of the law firm.

A recent judgment handed by the High Court of the United Kingdom, provides useful guidance on the extent of legal advice privilege in the context of regulatory investigations. The judgment which was handed by the High Court in the recent case of Property Alliance Group Limited v The Royal Bank of Scotland Plc [2015] EWHC 3187 (Ch),confirmed the well known principle established in the case of Balabel v Air India [1988] 1 Ch 317 that legal advice is not confined to telling the client the law; it must include advice as to what should prudently and sensibly be done in the relevant legal context.

During the past years English courts have been willing to interpret clauses as giving exclusive jurisdiction to the English courts, even though the word “exclusive” does not appear in the clause. Such an interpretation was given in the recent case of Global Maritime Investments Cyprus Limited v O.W. Supply & Trading A/S [2015] EWHC 2690 (Comm).

Due to the increased amount of divorces being filed in Cyprus coupled with the problems of having long delays on the hearings of family cases, the Parliament will discuss the possibility to amend Article 111 of the Constitution in order to reduce the number of judges to sit on the bench of the Family court from three to one.

In the case of Alpha Bank Cyprus Ltd v. Andrew Timothy Popple in March 2015 the Supreme Court of Cyprus had the opportunity to examine and apply Regulation (EC) No. 1393/2007, and made a significant statement in favour of simplification and acceleration of the process of service. The approach and analysis of the Highest Court of Cyprus can be seen to enhance the spirit of judicial cooperation and reflect the driving force behind the drafting of the provision.

Flows of illegal money can damage the integrity and stability of the financial sector but also may threaten the internal market of the European Union. The need to promote financial stability and curb the dangers fraught in Anti Money Laundering, has promoted the EU Parliament to pass the Fourth Anti Money Laundering Directive which has come into force on the 26th of June 2015. EU Member States will have to implement the Directive into domestic law within two years.

It has been officially yesterday reported by the Ministry of Finance of the Republic of Cyprus that after negotiations a protocol was concluded on the 2nd of July 2015 that will amend, upon its expiration, the existing Convention for the Avoidance of Double Taxation and the prevention of fiscal evasion with respect on taxes on income.
